Boathouse at Disney Springs files motion to dismiss negligence case against it

The restaurant is facing a lawsuit after a man died from severe hypoxia and cardiopulmonary arrest after choking on a piece of steak.

Boathouse Restaurant LLC is facing a lawsuit after a man died from choking on a piece of steak at Disney Springs June 8, 2025. 

The plaintiff, Reah Duncan, filed the lawsuit in October and is seeking more than $50,000 in damages, alleging negligent training and supervision. 

Duncan said the restaurant failed to promptly call 911 and instead called security. He suffered severe hypoxia and cardiopulmonary arrest. That same day he was put on a ventilator, but died the following the day. 

The delay in calling emergency services and the lack of training in medical emergencies is what caused the man to die, the lawsuit says. 

On Wednesday, Dec. 31, 2025, nearly two months after the lawsuit came about, Boathouse Restaurant LLC filed a motion to dismiss the case for failure to state a claim, which means it is asking the court to dismiss the case due to the lack of essential facts from Duncan’s claim.
