Windermere man accused of rapes requests bond

Darryl Patterson from Windermere is currently facing four counts of sexual battery and has asked the court to be released on bail until his trial.

WINDERMERE – After being denied bond following his arrest in September 2016, Darryl Wayne Patterson, 50, has been in the Orange County Jail awaiting trial for four counts of sexual battery on a person physically unable to resist.

But Patterson is now requesting Orange County Circuit judge Mark Blechman to review the motion and grant him bail. During a hearing held August 29, Windermere Police Detective John Allen took the stand to testify against granting Patterson bail.

Allen told the court that given Patterson’s history and the multiple cases he’s been charged with over a period of time, he’s concerned Patterson poses a threat to the community.

“At this point, multiple women have reported being raped by him and we have video recordings of him raping multiple women,” Allen said. “With that, we feel that, you know, he obviously would pose a threat to the community – particularly after I interviewed him in February (2015) and then one of the women came forward in April and said he tried to rape her in March (2015) despite knowing that the police were investigating him.”

Judge Blechman decided to review one of 28 video recordings found in Patterson’s home that depicts Patterson engaging in sexual acts with women who were all unconscious. The judge plans to watch the footage submitted as evidence in the case before making his determination on whether or not to grant Patterson’s request. 

According to Allen, Patterson’s defense team argued that Patterson should be given bail because the sexual acts shown in the video recordings do not represent a real rape.

“The defense counsel argued that he did not pose a threat to the community and that the case wasn’t very strong and these cases aren’t real rapes, and that he wasn’t a flight risk because he has family here and he’s a good guy,” Allen said.

According to court records, Patterson, who has been charged with two cases in Orange County and one in Hernando County, would stay with his father, Richard Patterson, if released on bail.

Judge Blechman will make a ruling during the bond hearing scheduled for Wednesday, September 6 at 10:15 a.m. in courtroom 12D. The trial is scheduled for October 23.
