Windermere Town Council to hold public hearing Sunset Bay Developers Agreement change

The request to amend several items in the agreement was tabled at a June Town Council meeting and will be revisited at tonight's meeting.

The Windermere Town Council will open up the floor to the public in regards to the first amendment to the Sunset Bay Developers Agreement at the meeting at 6 p.m. on Aug. 13 at Town Hall. 

The Sunset Bay Homeowners Association Inc. requested several changes and clarifications to the 31-year-old document at a June Town Council meeting.

The HOA requested several amendments be made to the agreements including:

-Setting a termination date for the agreement 

-Splitting the cost of future road repaving costs between the town and residents evenly

-Having the town assume responsibility for costs of lighting in the neighboring Down Pointe subdivision 

-Requiring the town to inspect any needed repairs to sidewalks along Sixth Avenue 

-Having the town fund any future sign repairs

-Granting permission to the HOA to build a six-foot-tall wall along the length of the property bordering Sixth Avenue. 

Proposed is an amendment addressing road, street and sign maintenance. It also acknowledges the town's requirement for the HOA to go through town channels to gain permission to build the Sixth Avenue wall instead of using the agreement. 

The proposed amendment does not address the HOA's request to add a termination date to the document. 

Also slated for the meeting is a vote on the new town facilities design and rezoning for properties on Fifth Avenue.
